Phone number on webshops is mandatory

During the FeWeb MeetUp about the vision of the Federal Public Service Economy on online legislation, the FPS announced that from 28 May 2022 the telephone number and e-mail address must be stated on a webshop. As a reminder, in this article we briefly summarize which legal notices you must provide on an e-commerce website.

1. Seller identification

• Name of the company
• Company form
• Address (no PO box)
• phone number
• E-mail address
• VAT and bank account number

This identification applies to both B2C and B2B.
You must identify yourself as a seller on every communication channel (website, social media page,…)

Attention : from May 2022 it is mandatory to state the telephone number and email address of the company.

2. Information at the start of the ordering process

This information must be provided on every page on which products or services are offered:

• Accepted means of payment
• Limitations in the offer
• Delivery Restrictions

3. Information just before the order

• Contact & complaints
  (Note: link to the European Online Dispute Resolution is mandatory)
• Pricing (total price)
• Costs (delivery, payment,…)
• Steps in the ordering process
• Right of withdrawal
  (Note: not in B2B and non-specific goods/services such as customized products, digital content, etc. The FPS Economy demands the use of the model form )
• Returns and costs return
  (Note: the consumer has 14 days to announce a return and then 14 days to carry out the return.)
  (Attention: ‘renvoyer le bien neuf dans son emballage d’origine’ ne peut pas être une raison pour perdre son droit de rétractation)
• The duration of the agreement (and termination conditions in the event of an indefinite term or with automatic renewal)
• Method of payment and delivery
• Main properties (for digital content also security and interoperability with hardware and software)
• Existence of legal guarantee
  (Note: “The 2 Year Statutory Warranty of Conformity for Consumer Goods applies”)
• Existence and method of after sales
• Existence of professional and sector codes
• Duration and cancellation agreement
